Purple woad. Or why hunting leases

Leasing land to hunt on is a big thing these days, and there is no sign of the phenomenon decreasing. Most of it is about deer and turkey hunting.

Hunting leases have been popular for a long time in states with little public land, like Texas, but the practice is now spreading to remote areas like suburban farms around Philadelphia and Maryland. So high is the demand for quality hunting land, and for just finding a place to hunt without being bothered, and so limited is the resource becoming, that leasing is a natural step for many landowners who want to get some extra income to pay their rent or fief to the government (property taxes aka build-a-union-teacher’s-public-pension-fund).

Having been approached about leasing land I own and manage, it is something I considered and then rejected. If a landowner at all personally enjoys their own land themselves, enjoys their privacy there, enjoys the health of their land, then leasing is not for you. Bear in mind that leasing also carries some legal liability risk, and so you have to carry sufficient insurance to cover any lawsuits that might begin on your land.

Nonetheless, some private land is being leased, having been posted before that. And the reason that so many land owners are overcoming the same hurdles that I myself went through when considering land leasing, is that in some cases the money is high enough. Enough people want badly enough to have their own place that they can hunt on exclusively, that they are willing to pay real money.

Makes you wonder what kind of population pressures and open land decreases America has seen over the past fifty years to lead to this kind of change in land use. Makes me think of one anecdotal experience.

On the Sunday of Memorial Day Weekend of 2007, I drove up to Pine Creek to dig the footers for our barn. All the way up I shared the road, in both directions, with two motorcyclists headed in my same direction. That is it. In addition to my pickup, a grand total of two vehicles out for a Sunday drive in the country were on Route 44 and Rt 414.

Fast forward 13 years and my gosh, Pine Creek Valley has nonstop traffic in both directions at all hours. It does not matter what the time of day or night is, there are vehicles going in both directions. And not just oversize pickup trucks possibly associated with the gas drilling occurring around the area. Little tiny dinky tin can cars are going up and down the valley, too. There are literally people everywhere here now, in what had been the most remote, undeveloped, quietest corner of rural Pennsylvania. Even if you go bear hunting on some sidehill in the middle of nowhere up in Pine Creek Valley, you will encounter another hunting gang or two. Which for bear hunting is actually a good thing, but the point being that there are people everywhere everywhere everywhere in rural Pennsylvania.

OK, here is another brief anecdote. Ladies, skip ahead to the next paragraph. About ten years ago I was fishing on the north end of the Chesapeake Bay. When I was finished for the day, I drove back north toward home. At one point I had an urge to pee, so I began looking for a place I could pull off and pull out, without offending anyone. Yes, I have my modest moments. And you know what? The entire region between The Chesapeake Bay’s northern shores and the Pennsylvania Mason-Dixon Line, is completely developed. Like wall-to-wall one-two-three-acre residential lots on every inch of land surface. At the one place that finally looked like I was finally going to get some relief, I stepped out of the car and was immediately met with a parade of Mini Coopers and Priuses driving by on the gravel road to their wooded home lots. There was literally people everywhere, in every corner, in every place.

So what happened here?

There are more people and there is more land development, both of which leading to less nice land to hunt, fewer big private spaces for people to call their own, and so that which does exist is in much higher demand.

Enter Pennsylvania’s new No Trespassing law. AKA the “purple paint” law.

Why was this new law even needed? Because the disenfranchised, enslaved Scots-Irish refugees who originally settled the Pennsylvania frontier by dint of gumption, bravery, and hard work had a natural opposition to the notions and forms of European aristocracy that had driven them here. Such as large pieces of private land being closed off to hunting and fishing. And so these Scots-Irish settlers developed an Indian-like culture of openly flouting the marked boundaries of private properties. Especially when they hunted.

And this culture of ignoring No Trespassing signs carries forth to this very day.

Except that now it is 2020, not 1820, and there are more damned people on the landscape and a hell of a lot less land for those people to roam about on. Nice large pieces of truly private land are becoming something of a rarity in a lot of places. Heck, even the once-rural Poconos is now just an aluminum siding and brick suburb of Joizy.

So in response to our collision of frontier culture with ever more valuable privacy rights, Pennsylvania now has a new purple paint law. If you see purple paint on a tree, it is the equivalent of a No Trespassing sign. And if you do trespass and you get caught, the penalties are much tougher and more expensive than they were just a few months ago.

And you know what the real irony is of this purple paint stay-the-hell-out boundary thing? It is a lot like the blue woad that the Celtic ancestors of the Scots and Irish used to paint their bodies with  before entering into battle. Except it is now the landowner who has painted himself in war paint.

Isn’t life funny.

Re: Disaster Named Harrisburg, Kudos to Judge John McNally

Dauphin County Judge John McNally made me feel so proud the other day, because he held the City of Harrisburg liable for all the major bullhooey it has poured onto mere citizen Mike Brenner. Brenner has literally been fighting City Hall because City Hall brought the fight to him.

Brenner made the mistake of leasing his property to the Harrisburg City Public Works Department, where men and machines are stored. After the city stopped paying rent to him for the use of his property, but nonetheless occupied the premises and allowed it to fall into disrepair like the rest of Harrisburg has, Brenner went to court.

Who wouldn’t go to court in these circumstances? The law is the law is the law, and no one is supposed to be above the law. The law is supposed to apply to everyone equally, and especially to government agencies and entities.

Well…the temerity of this citizen! Who is he to expect just compensation from the City of Harrisburg?! Who is he to expect the city to live up to its legal obligations?

So instead of being a standup guy and paying Brenner what he has been long owed, Mayor Eric Papenfuse decided that the city would not only renege on its signed lease with Brenner, but then commence eminent domain proceedings against him to take the property by force.

So here we have a county judge who recognizes corruption and evil when we and he sees it, as personified by the sweaty faced lump of Jello that is Eric Papenfuse, and he issues a decision that the city must actually live up to its lease terms and pay Brenner what the city owes him. Never mind that what the city is doing, what Eric Papenfuse is doing, is downright evil and the very definition of abuse of official power.

Does anyone wonder why Harrisburg has fallen to pieces over the past four decades, with most taxpayers fleeing to better locales? All my life I have either visited my family here, or lived here, and it just keeps getting worse and worse.

Thanks only to Judge John McNally, Harrisburg City’s mayor is getting the comeuppance he has long been due to receive. Now let’s see the citizens of Harrisburg wake the hell up and begin voting for better human beings to make our city’s official decisions for us. We cannot afford losers like Papenfuse to continue to bankrupt Pennsylvania’s capital city with petty coercion and minor league control games.

p.s. When first elected as mayor, Papenfuse swore that people would go to jail for the fraudulent incinerator debacle that bankrupted the city. Several years later he has swept it all under the rug. Eric, you are an incompetent, lying sack of sh*t, and you cannot go back to running your used bookstore soon enough. Then let the federal charges begin to rain down on his sweaty, greasy head.

p.p.s. I am a plaintiff in an ongoing lawsuit against my beloved city over its patently illegal anti-gun ordinances it passed several years ago. Papenfuse has also engaged in a lot of virtue signalling with that unnecessary lawsuit, while costing us taxpayers yet more money. The guy is a disaster.

I am a happy PA Game Commission partner

For the past ten years, we have enrolled 350 acres in Centre County with the Pennsylvania Game Commission’s public access program.

We pay the taxes on the land, the PGC patrols the land, and the public hunts and traps on the land. From personal items left lying on the ground, like underpants and beer cans, it is clear that some members of the public are using it in more creative recreational ways.

Cleaning up these things is part of the burden we bear to provide the public with nice places to hunt and…”picnic.”

Because our land is surrounded by State Game Lands, it made sense to open it to the public.  We were approached to lease it as a private hunting club, and we have resisted that for all these years.  We recently sold 100 acres to PGC, and we wanted it to be a seamless experience for the public, used to walking in on a gated road and immediately hunting.

Overall our experience has been positive.  Yes, we get frustrated by people leaving trash behind, when they could easily put it in the vehicle they brought it in with. But we take great satisfaction knowing that the majority of visitors are exhilarated to be there, and they use the land respectfully.

Our family is proud to help other Pennsylvanians have a beautiful place to hunt and trap, so that these ancient skills can be passed on to younger generations.  We are proud and pleased to partner with the Pennsylvania Game Commission.

 

Harrisburg’s new parking scam

Today I parked in a Harrisburg municipal garage. Got my ticket when I entered, and tried to pay when I returned four hours later.

Several poorly written, hand-written notes on lined paper were taped to the payment kiosk. These notes said that the kiosk was now taking only exact payment, that no refunds were being given, that inserting your credit card to pay could result in the permanent loss of your card, and that receipts slips were not printing.

In other words, you might mistakenly over-pay, because few people carry exact cash for anything, the machine would not give you a receipt for proof that you had overpaid, and you’d get no change back.  What happens if you are in a rush to exit the garage and get on your way to your next destination?  You might just leave a few extra bucks behind to save the time…no doubt that’s part of the purpose.

And we are not talking about nickels and dimes, but dollars only. It cost sixteen bucks to park in the garage for the four hours I was up at the Capitol. That is four dollars an hour, or four quarters for fifteen minutes of parking time (as opposed to one quarter for ten or fifteen minutes like it was until last year). It is a huge amount of money for parking.

And on top of the rip-off parking price, you get zero service, theft of your change due back, and no receipt to prove you did indeed pay.

Harrisburg has some serious challenges, and this parking scam is going to make recovery worse. One of the ways the city is supposed to re-coup its bad debt on the incinerator is lease out the parking garages. Well, here ya go; here is the natural result of that leasing arrangement: All rip-off, no service, outrageous prices, no due process. Really hope the “geniuses” who thought this up are held accountable for this failure.

Wait a minute! The guys who ripped us all off with the incinerator debt never got held accountable, and now we have a whole new set of rip-off guys milking us in new ways. I guess it just doesn’t end, until every taxpayer will have moved from the city and abandoned the place to the crows and the weasels.

Your Private Property Rights: Born, and Possibly Died, on the Fourth of July

One hundred and fifty years ago today, in Gettysburg, Pennsylvania, America’s most hallowed ground was established. Over fifty thousand casualties among both Union and Confederate forces resulted from fierce acts of bravery and heroism on both sides over just a few days, including Pickett’s famous last-ditch assault on the Union center, into the teeth of point-blank cannon fire, canister, and grape shot.

The ferocious hand-to-hand fighting along Pickett’s front established the “high water mark” of the Confederacy, and produced the most focused military effort to date by the Union, the success of which gave impetus to the North’s final push to end a malingering war. To make those sacrifices and take those personal risks, you’ve got to really believe in something, a truth summed up brilliantly in Lincoln’s Gettysburg Address. The fact that the battle culminated on Independence Day was not lost on either side.

Ten years ago, I had the honor of purchasing the last outstanding parcel of land on which Pickett’s Charge occurred, at the far eastern end of the field, where the Ohio 8th Regiment was dug in. Over the prior 19 years, the National Park Service had unsuccessfully pursued the “Home Sweet Home” motel, a 1950s-era no-tell hotel on two acres there. It paved over a hasty trench and a temporary field hospital where men from both armies had been treated, before archaeology became vogue.

By 2004, the motel and its blacktop were themselves things of the past, the site archaeology was done, and the final resting place of so many distinguished soldiers was returned to serene grass. It was one of the high points of my career, and I worked so hard on it because, like other Americans who visit Gettysburg, read the Gettysburg Address, and understand Gettysburg’s role, its meaning inspired me. Preserving the Union meant continuing and expanding the American dream. Protecting the Home Sweet Home site meant preserving Gettysburg’s symbolism, protecting that hallowed ground, and enshrining the American Dream of opportunity for all.

One of the most inspiring aspects of America, and core to the American Dream, is the universal concept of private property rights. Because of America’s unique private property rights system, generations of immigrants have moved across mountains and oceans to become Americans, toil hard, and take risks and make sacrifices to improve their standard of living. For hundreds of years, anyone who was willing to work hard could use their private property rights to shelter and feed their family, purchase an education for their children, and build equity for the day when their hands and back might no longer be able to physically toil.

But here in Pennsylvania, just days ago and, oddly, just days before Independence Day, the state legislature passed a two-sentence bill gutting the private property rights of landowners who have leased their land for oil and gas exploration. It was a shameful thing to do, and it is an echo of the midnight legislative pay-raise that cost so many incumbents their seats a few years ago. It is the shady act of some self- anointed few to enrich their political friends, at the huge cost of Pennsylvania’s private landowners.

As I understand it, Governor Tom Corbett is weighing whether or not to sign it into law. I hope he does not sign it. To enact such a law flies in the face of everything that is American. It is against everything that Independence Day stands for. It is against everything that the men at Gettysburg fought and died for, and against everything that America’s Founding Fathers and brave patriots fought for in 1776.

I wish you a happy Independence Day today, and in its spirit I ask that you call your state legislators, and ask them if they voted for this un-American oil and gas bill. If they did, vote them out of office, and show them that the Spirit of 1776 still stands strong. You deserve better, I deserve better, America deserves better.

Property rights, anyone? Republicans? Hello?

My fellow Republicans have just passed a two-sentence law that single-handedly strips away private property rights from private landowners in Pennsylvania, and Governor Tom Corbett is weighing whether or not to sign it.

To wit: If you signed an oil and gas lease that is still in force, and it is silent on being unitized with some other gas drilling unit miles away, why then, the gas company can put you in that unit, begin paying you some paltry sum, and your lease never ends. The gas company can come back for your gas decades later. You are completely stuck and do not have the opportunity to renegotiate better terms for a new lease.

Never mind that the same “Republicans” who propagated this anti-American Communist plot are also the same ones who were championing forced pooling, too.

Some of these jokers are in the administration, so more on them later, on an as-needed basis. Keep in mind that some of these guys, and one person comes to my mind immediately, have never made a dollar in the private sector. Rather, their entire Republican careers have been spent on the taxpayer dole, in some public role or another. And here they have the cajones to try to strip private landowners of their private property rights.

Many voters know me as an American political activist first, and a Republican last. This recent vote in both the PA House and PA Senate reconfirms for me that my beliefs best lie with the more independent-minded, and not with the partisans. It is a sad fact that Democrats are for forced pooling, too, and also believe that private property rights are best managed by government or its corporate buddies.

But that is not my fight. I am a conservative and a Republican, and by God, when I see something that stinks this bad, I am calling it what it is: Crap.

The Republican Party ought to be made of better people who know better. For shame.
